Terms of Service

1. Acceptance of Terms

By creating an account or using ArbreCRM ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you ("Customer", "you") and ArbreCRM ("we", "us", "our").

2. Description of Service

ArbreCRM is a cloud-based software-as-a-service (SaaS) platform designed for tree service and arborist companies. The Service includes client management, quoting, job scheduling, invoicing, crew management, equipment tracking, and related tools.

We may update, modify, or discontinue features at any time with reasonable notice. New features may be subject to additional terms.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of your business.

One account may be used only by one business entity. You may not share your account credentials with individuals outside your organization.

4. Subscription & Billing

ArbreCRM offers paid subscription plans billed monthly or annually. Prices are displayed on our pricing page and may change with 30 days' notice.

  • Payment is processed securely through Stripe. We do not store your credit card information.
  • Subscriptions automatically renew unless cancelled before the end of the billing period.
  • You may cancel your subscription at any time from your billing settings. Access continues until the end of the current billing period.
  • Refunds are handled on a case-by-case basis. Contact support@arbrecrm.com for refund requests.
  • Free trial accounts have full access for the trial period. No credit card is required to start a trial.

5. Acceptable Use

You agree to use the Service only for lawful business purposes related to tree service operations. You may not:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to access other users' accounts or data
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Upload malicious code, viruses, or harmful content
  • Use the Service to send unsolicited bulk communications (spam)
  • Resell, sublicense, or redistribute the Service without written permission

6. Your Data & Intellectual Property

You retain full ownership of all data you enter into ArbreCRM, including client records, quotes, invoices, photos, signatures, and business information ("Your Data").

We do not sell, share, or use Your Data for any purpose other than providing the Service. We may access Your Data only for technical support, with your permission, or as required by law.

You may export Your Data at any time. Upon account cancellation, Your Data is retained for 30 days before permanent deletion, unless you request earlier deletion.

All intellectual property in the Service (code, design, trademarks, documentation) belongs to ArbreCRM. These Terms do not grant you any rights to our intellectual property beyond the right to use the Service.

7. Privacy & Data Protection

Your use of the Service is also governed by our Privacy Policy. We are committed to protecting your data in compliance with applicable Canadian and US privacy laws, including PIPEDA (Canada) and applicable state privacy laws (United States). See our Privacy Policy.

8. Service Availability & Support

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice when possible.

Technical support is available via email at support@arbrecrm.com. Response times depend on your subscription plan.

9. Limitation of Liability

To the maximum extent permitted by law, ArbreCRM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

The Service is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Indemnification

You agree to indemnify and hold ArbreCRM harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

Either party may terminate this agreement at any time. You may cancel your subscription through your billing settings.

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or fail to pay subscription fees after reasonable notice.

Upon termination, your right to use the Service ceases. Your Data will be retained for 30 days, after which it will be permanently deleted.

12. Governing Law & Disputes

These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Quebec.

For customers in the United States, you agree that any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
